Terms of Service

1. Who we are and what these terms cover

Pin the Date is operated by Mar&Co Management B.V., registered in the Netherlands, Chamber of Commerce (KvK) number 94664404("Pin the Date", "we", "us", "our"). These terms form a binding agreement between you and us and govern your access to and use of the Pin the Date websites, the free community calendars, the calendar feeds, and, where made available, brand accounts and related features (together, the "Service"). By using the Service you agree to these terms. If you do not agree, do not use the Service.

2. Definitions

Community calendarmeans a free calendar we publish, such as a football club's fixtures, that you can add to your own calendar app.
Feed means the private calendar-feed address we generate for you when you sync a community calendar.
Brand account means a paid or free account through which an organisation publishes its own calendars to its own audience.
Content means the event and calendar information made available through the Service.

3. Eligibility

The Service is intended for people aged 16 and over, and by using it you confirm that you are at least 16 years old. Marketing is offered only to people aged 16 and over, and we use the date of birth you give at sign-up to enforce that. If a person under 16 uses the Service, a parent or guardian must agree to and supervise that use. If you are accepting these terms on behalf of an organisation, you confirm that you have authority to bind it.

4. The community calendars

The community calendars are provided free of charge. When you sync one, we create a Feed that your calendar app fetches periodically so that fixtures, times and changes update automatically. The timing of those updates is controlled by your calendar provider and is not real-time, and subscribed calendar feeds cannot be relied upon to trigger reminders or notifications. We may add, change, or discontinue community calendars at any time.

5. Where the data comes from, and its accuracy

Fixture and event information in the community calendars is compiled from third-party data sources. We take care to keep it current, but we do not create this information and cannot guarantee that it is accurate, complete or up to date. Fixtures are frequently rescheduled, postponed or corrected. You should not rely on the Service as the sole source for any decision that matters to you, and you should confirm important dates and times with the official source. We treat this fixture information as publicly available factual data that we compile rather than own.

No affiliation. Pin the Date is an independent service. Unless we state otherwise in writing, we are not affiliated with, endorsed by, or licensed by any league, club, competition organiser or governing body. Team names, competition names, logos and other trademarks are the property of their respective owners and are used only to identify the calendar you are viewing. If you are a rights holder and have a concern about how your data or marks are used, contact hi@pinthedate.com and we will respond promptly.

6. Signing up and your responsibilities

Some features ask for information such as your name and email. You agree to provide accurate information and to keep it current. The private link to your Feed and to your self-service page acts as your credential: anyone who has it can view, manage or delete your subscription, so keep it private and do not share it. You are responsible for activity that takes place through your Feed or account.

7. Acceptable use

You agree not to:

  • use the Service unlawfully, or to infringe the rights of others;
  • copy, scrape, resell or redistribute the Content or the Feeds at scale, or build a competing dataset from them;
  • attempt to gain unauthorised access to the Service, or to disrupt or overload it;
  • circumvent security, rate limits or access controls;
  • use the Service to send unsolicited marketing or other unlawful messages.

8. Intellectual property

The Service itself, including its software, design and branding, belongs to us or our licensors and is protected by law. We grant you a personal, non-exclusive, non-transferable right to use the Service and to add community calendars to your own calendar app for your own use. Third-party data and marks remain the property of their owners, as set out in section 5.

9. Brand accounts

Where brand accounts are made available, additional terms apply. A brand is responsible for the calendars and subscriber data it manages through the Service, including having a lawful basis to collect and use that data and maintaining its own privacy notice. As between you and the brand, the brand is the controller of its subscribers' personal data and we act as its processor under a separate data processing agreement. Paid plans, where offered, are billed as described at the point of sale, in advance, and are non-refundable except where the law requires otherwise.

Our privacy policy explains how we handle personal data and forms part of these terms. Please read it.

11. Availability and changes to the Service

We work to keep the Service reliable but provide it "as is" and "as available", without warranties of any kind to the extent permitted by law. We may change, suspend or discontinue any part of the Service, and we may update these terms. If a change is material we will give reasonable notice, for example by a notice on the site. Continued use after a change takes effect means you accept the updated terms.

12. Liability

Nothing in these terms limits liability that cannot be limited by law, including liability for intent or gross negligence, for death or personal injury caused by our negligence, or your mandatory rights as a consumer under Dutch law. Subject to that, and to the maximum extent permitted by law, we are not liable for indirect or consequential loss, or for loss arising from reliance on the accuracy or timeliness of the Content. Because the community calendars are provided free of charge, our total liability arising from them is limited to the maximum extent the law allows. For paid brand accounts, our total liability is limited to the fees paid in the twelve months before the event giving rise to the claim.

13. Suspension and termination

You may stop using the Service at any time, and you can remove your data from your self-service page. We may suspend or end your access if you breach these terms or to protect the Service or other users. Where a brand account is terminated, you can export your data for a reasonable period before it is deleted. Provisions that by their nature should survive termination, such as sections 5, 7, 8 and 12, will survive.

14. Governing law and disputes

These terms are governed by the law of the Netherlands. Disputes will be submitted to the competent court in the Netherlands, unless mandatory consumer law gives you the right to bring proceedings elsewhere. Consumers in the EU may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.

15. General

If any provision of these terms is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. You may not transfer your rights under these terms without our consent; we may transfer ours to a successor of our business. These terms, together with the privacy policy, are the entire agreement between you and us regarding the Service.
